1. ACCEPTANCE OF TERMS

By accessing, browsing, or using the website https://paramountroofing.ca/, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use, our Privacy Policy, and all applicable laws and regulations. This agreement constitutes a legally binding contract between you and Paramount Roofing . If you do not agree with any part of these Terms, you are expressly prohibited from using the Site and must discontinue use immediately.

2. MODIFICATIONS TO THESE TERMS

Paramount Roofing reserves the right to modify these Terms of Use at any time, at its sole discretion. Any modification takes effect as soon as it is published on the Site. It is your responsibility to review these Terms periodically; continued use of the Site after modifications are posted constitutes your acceptance of those changes.

3. SMS MESSAGING & COMPLIANCE

Program Description: Paramount Roofing operates a mobile messaging program designed to improve communication with clients. This program delivers project updates, appointment confirmations, and customer support responses to individuals who have engaged our services or submitted inquiries through our digital contact forms.

Verified Opt-In: Explicit consent is a prerequisite for enrollment. Consent is collected exclusively through our online forms via a dedicated checkbox, unchecked by default, for SMS notifications. By checking this box, you provide express agreement to receive automated and manual text messages, in accordance with Canada’s Anti-Spam Legislation (CASL).

Cancellation and Opt-Out: You retain the right to withdraw your consent at any time. To cancel the SMS service, simply text the keyword “STOP” to the number from which you receive messages. Upon receiving your request, we will send a single confirmation SMS to confirm your opt-out.

Support and Help: If you experience technical difficulties or have questions about our messaging program, reply to any of our messages with the keyword “HELP” for automated assistance, or write directly to Info@ParamountRoofing.ca.

Rates and Frequency: Message and data rates may apply according to your mobile carrier’s plan for any message sent or received from us. Message frequency varies based on your level of engagement with our services and support requests.

Carrier Liability: Mobile carriers (including Bell, Rogers, Telus, Vidéotron, Freedom Mobile, and various regional providers) operate independently, under the regulation of the Canadian Radio-television and Telecommunications Commission (CRTC), and are not liable for delayed, undelivered, or misdirected messages.

4. INTELLECTUAL PROPERTY RIGHTS

The Site and all of its original content, features, and functionality — including text, source code, logos, proprietary graphics, and software — are the exclusive property of Paramount Roofing and are protected by applicable copyright, trademark, and other intellectual property laws.

Limited License: We grant you a personal, non-exclusive, non-transferable, and revocable license to access and use the Site for personal, non-commercial purposes.

Strict Restrictions: You are expressly prohibited from modifying, copying, reproducing, republishing, uploading, or distributing any content from this Site in any format without the prior express written permission of Paramount Roofing. Any unauthorized use of the Site’s content may result in immediate termination of your license and legal action.

5. USER CONDUCT AND SUBMITTED CONTENT

You also waive, to the extent permitted by applicable law, any moral rights you may have in that content as against Paramount Roofing, it being understood that under Canadian law moral rights cannot be assigned but may be waived.

The information, products, and professional services offered through the Site are provided “as is” and “as available,” without warranties of any kind, express or implied, to the extent permitted by applicable law. We do not warrant that the Site will operate uninterrupted, that it will be free of viruses, or that any defects will be corrected. Furthermore, we disclaim any responsibility for the content, privacy policies, or reliability of any third-party website that may be linked to or from our Site.

Nothing in this section is intended to exclude or limit any statutory warranties or rights you may have under the consumer protection legislation applicable in your province or territory, or any other law of public order that cannot be waived by contract.

7. LIMITATION OF LIABILITY

Paramount Roofing, to the maximum extent permitted by applicable law, shall in no event be liable for any indirect, incidental, special, or consequential damages, including without limitation loss of data, loss of business profits, or business interruption arising from the use or inability to use the Site’s content, even if we have been advised of the possibility of such damages. Upon termination, your right to use the Site ceases immediately.

11. GOVERNING LAW AND JURISDICTION

• Waiver: The failure to exercise any right under these Terms does not constitute a waiver of that right.
• Force Majeure: Neither party shall be liable for any delay or failure to perform resulting from a cause beyond its reasonable control.
